Welcome to ReviewSend, operated by Isaiah B Enterprises LLC. By accessing or using our platform at reviewsend.io, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Acceptance of Terms

By creating an account or using ReviewSend in any way, you confirm that you are at least 18 years old, have the authority to bind any business entity on whose behalf you are using the platform, and agree to these Terms of Service and our Privacy Policy.

2. Description of Services

ReviewSend provides a platform for businesses to:

Send SMS review requests to customers
Manage and post photos to Google, Instagram, and Facebook
Monitor online reputation across Google and Yelp
Access analytics and reputation reporting
Manage team members and client accounts

3. SMS Program Terms

SMS Program Details — Required Disclosure

Program Name: ReviewSend SMS Review Requests

Program Description: ReviewSend enables local businesses to send a single one-time SMS message to customers after a completed service, containing a direct link to leave a Google or Yelp review.

Message Frequency: One (1) message per customer per review request. No recurring messages.

Message & Data Rates: Message and data rates may apply.

Opt-Out: Reply STOP to any message to unsubscribe immediately. No further messages will be sent.

4. SMS Messaging and TCPA Compliance

You are responsible for ensuring you have proper consent from every recipient before sending them an SMS message through ReviewSend.

By using our SMS features, you agree to:

Only send messages to individuals who have provided prior express verbal consent to receive SMS messages from your business at the point of service
Comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and local laws governing electronic communications
Not use ReviewSend to send unsolicited messages, spam, or messages to individuals who have opted out
Never use purchased, rented, or third-party phone number lists
Only send messages to existing customers who have voluntarily provided their phone number directly to your business
Maintain records of customer consent where required by law
Honor all opt-out requests immediately — any customer who replies STOP must be removed from future messaging

All messages sent through ReviewSend automatically include opt-out instructions (reply STOP to unsubscribe). ReviewSend reserves the right to suspend or terminate accounts found to be in violation of messaging laws or our acceptable use policy.

5. User Responsibilities

You agree not to use ReviewSend to:

Violate any applicable law or regulation
Send deceptive, fraudulent, or misleading content
Harass, abuse, or harm any individual
Upload content that infringes on intellectual property rights
Attempt to gain unauthorized access to our systems or other users' accounts
Resell or sublicense access to ReviewSend without written permission

6. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at support.reviewsend@gmail.com.

7. Payment and Billing

Subscription fees are billed in advance on a recurring basis. All fees are non-refundable except as required by law. ReviewSend reserves the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

8. Intellectual Property

ReviewSend and its original content, features, and functionality are owned by ReviewSend and are protected by copyright and other intellectual property laws. You retain ownership of all content you upload to the platform.

9. Third-Party Services

ReviewSend integrates with third-party services including Twilio (SMS), Google Business Profile, Instagram, and Facebook. Your use of these integrations is subject to those providers' terms of service. ReviewSend is not responsible for the availability or actions of third-party services.

10. Limitation of Liability

ReviewSend is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, ReviewSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, revenue, or business opportunities.

Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to ReviewSend in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ReviewSend and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights including TCPA violations resulting from your messaging practices.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any conduct that we determine to be harmful to other users, our platform, or third parties. You may cancel your account at any time by contacting us.

13. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Broward County, Florida.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page with an updated effective date. Continued use of the platform after changes constitutes acceptance of the new Terms.
